SB 292 - Supporting Transparency While Reaffirming Opposition to Eminent Domain

The Libertarian Party of Texas (LPTexas) supports Senate Bill 292, which strengthens protections for landowners during the eminent domain process. While LPTexas remains fundamentally opposed to the use of eminent domain in any form, this bill provides necessary reforms to increase transparency for property owners facing government or corporate condemnation attempts.

  1. Reaffirming Opposition to Eminent Domain
    LPTexas opposes eminent domain as an unjust violation of private property rights. No government or entity should have the authority to seize private land for any purpose, whether public or private. The existence of eminent domain power represents an inherent overreach incompatible with the principles of individual liberty and voluntary exchange (Platform I.2 – Property Rights).

  2. Improving Landowner Transparency and Informed Consent
    Although we oppose the practice of eminent domain, LPTexas supports SB 292’s requirement that property owners receive clearer, earlier notification of their rights—specifically the right to refuse access for surveys, to negotiate survey terms, and to understand potential legal actions. These reforms empower landowners and reduce the asymmetry of information often exploited by condemning authorities.

  3. Limiting Abuse and Increasing Accountability
    SB 292 provides structural safeguards by requiring separate, clearly identified offers for property sought by condemnation versus property sought voluntarily. This change increases transparency and makes it more difficult for condemning entities to pressure landowners into unnecessary or coerced sales.

Conclusion
While the Libertarian Party of Texas rejects the legitimacy of eminent domain, we support SB 292 as a step toward increasing landowner protection, transparency, and accountability within the current legal framework. We continue to call for the full abolition of eminent domain powers and the restoration of absolute property rights for all Texans.
