Protecting Free Speech and Assembly in Private Communities
Posted by Anastasia Wilford · April 02, 2025
The Libertarian Party of Texas (LPTexas) supports House Bill 621, which limits the ability of property owners' associations (POAs) to restrict residents' political expression and peaceful assembly in common areas. This bill promotes the fundamental rights of free speech and political participation—values central to a free society.
Defending Political Expression and Civic Engagement
HB 621 ensures that residents of private communities are not barred from inviting candidates or public officials to speak or meet with neighbors. LPTexas holds that freedom of speech and the right to peaceably assemble must be protected in all forums where individuals voluntarily associate, especially when discussing matters of governance.
Limiting Overreach by Private Governance Bodies
While we support voluntary associations, LPTexas opposes private rulemaking that mimics the worst coercive tendencies of government. When POAs attempt to suppress political activity or expression, they infringe on essential liberties under the guise of property management.
Ensuring Equal Treatment and Access
HB 621 still allows POAs to enforce neutral policies (e.g., room reservations, occupancy limits), but prohibits them from singling out political events or speakers for exclusion. This strikes an appropriate balance between reasonable property use and fundamental freedoms.
Conclusion
The Libertarian Party of Texas urges the Legislature to pass HB 621. The right to speak freely and assemble in peaceful political discourse must not be subordinated to the preferences of property managers. LPTexas supports this bill as a step toward safeguarding individual rights in all communities—public and private alike.
