Defending Due Process and the Expansion of Voter Disenfranchisement Powers

The Libertarian Party of Texas (LPTexas) opposes House Bill 2279, which mandates the cancellation of a person’s voter registration upon notice that the individual has acknowledged non-citizenship, including information derived from jury disqualification lists.
While LPTexas supports transparent and verifiable elections, we also strongly oppose the expansion of state surveillance and bureaucratic overreach that threatens individual liberty and due process. The use of third-party or indirect data, such as jury disqualifications, to revoke voting rights without direct verification or an opportunity to contest the cancellation undermines fundamental rights and due process protections.
LPTexas asserts that:

Voting rights must not be subject to administrative revocation without due process. Cancellation based on lists not originally created for voter registration purposes invites errors, abuse, and wrongful disenfranchisement.

Government force should be minimized, especially in areas affecting civil liberties. H.B. 2279 increases state authority to act unilaterally without clear evidence or individual recourse, contrary to the principles outlined in the LPTexas Statement of Principles.

Privacy is paramount. We oppose cross-referencing unrelated government databases to make decisions that affect individuals’ rights, which violates both privacy and the spirit of limited government outlined in our platform (Section I.4.a).
Therefore, LPTexas urges the Texas Legislature to reject H.B. 2279 and instead support reforms that protect election integrity while also preserving the individual liberties of all Texans.
